Herr Wehrminister* Rumsfeld (or is he Schutzherr?*) thinks “Adolf Hitler was elected legally” (as reported in the press in early February, 2006).

Rumsfeld spoke to criticize Hugo Chavez and Evo Morales. Noting that they were “elected legally”, Rumsfeld intended the Hitler remark to diminish the fact that Chavez and Morales were each elected with a majority.

Hitler was appointed Chancellor by President Hindenburg on January 30, 1933. Hitler and the Nazis never were elected: “At the crest of their electoral strength, in July 1932, the National Socialists had attained but 37 per cent of the vote.” And in the last election prior to Hitler’s appointment (November, 1932), the Nazis got even fewer votes. See William L. Shirer, “The Rise and Fall of the Third Reich”, ©1960, at pp. 185 - 187.

Hindenburg acted constitutionally, in 1933, under the charter of the Weimar Republic, says Shirer.

Did our Supreme Court act constitutionally in 2000, when George W. Bush did not get a majority of the votes cast?

*“Wehrminister” seems the best usage for Defense Secretary; “Schutzherr” is a patron and protector.
